The Nevada Judge Halverson Case Does Put a Ding the Nevada Taxpayer’s Wallet

WIth all the circus happening in Nevada in a very compelling case of judicial misconduct aganist Judge Elizabeth Halverson, this case is making Nevada taxpayers angry as this case is making national attention.  Why does this make Nevada Taxpayers angry:

  1. Judge Halverson as a suspended judge is still collecting on her $130,000 a year salary despite she is suspended.
  2. The Nevada Commission on Judicial Discipline is paying $150 a hour for a special prosecutor that is prosecuting Judge Halverson.  The trial has went on for seven days and averaged 10 hours a day.   That is $10,500 of Nevada’s taxpayer dollars.
  3. If you got subponeaed as long you were not a laywer or judge, you were paid to testify, $25 plus mileage of 58.5 cents a mile.
  4. The Commission members traveled from way up-north in Nevada by Reno and Carson City, and these members are entitled to a $85 dollar a day per-diem like Wisconsin Legislators do.

This simple hearing, turned into a dog and pony show by Judge Elizabeth Halverson shows this case has really costed the taxpayers of Nevada.

    The actual time spent by the special prosecutor at the August, 2008 disciplinary hearing is a drop in the bucket.

    Among other things requiring the special prosecutor to burn legal fees (like out-of court preparation, which generally exceeds the time in court, responding to Halverson’s written hearing motions, and the prior length hearing resulting in Halverson’s temporary suspension), Halverson previously filed two different appellate proceedings in the Nevada Supreme Court to which the special prosecutor was obliged to respond with legal briefs, and has been required to defend a federal court civil rights action.

    Halverson also filed two additional appellate proceedings in the Nevada Supreme Court that the special prosecutor was not involved in, but required public funds to respond to (the Quo Warranto proceeding against Chief Judge Kathy Hardcastle and the writ petition Halverson filed against the registrar of voters to invalidate Halverson’s 2 year term, and increase it to 6 years).

    I would be surprised if the true amount of the fees billed by the special prosecutor were under $75,000, and the total attorney fees expended by the State of Nevada was under $125,000.

    It is not Judge Halverson that has cost the taxpayers money. It is Chief Judge Kathy Hardcastle and Court Administration who bought in to Hardcastle’s vindictive games.

    All Halverson wanted to do was the job the taxpayers elected her to do. It was Hardcastle who was bent on destroying Halverson and put her under a microscope and created all this nonsense. There is a very small percentage of Judges in Nevada that have not dozed off in a trial. (if you think different you are kidding yourself). There is little to no judges who have not yelled at staff or made them angry at one point or another(heck I get ticked at my boss several times a month).

    All these charges are bogus and blown out of proportion. Del Vecchio is alledged of sexual deeds with a MINOR. He is a FAMILY court judge. Those charges were brought up 2 years ago and the committee has not gotten around to a hearing for him and he has not missed a day of work. Yet, Halverson, is considered a threat to justice??? WHAT????

    There is only one person to blame for all this nonsense and cost, and it is NOT Judge Halverson. Open your eyes folks.

    Perhaps on that other family judge, that is one of the many cases these judicial commissions refuse to hear. They look at 500-700 complaints and only hear few. This happens in every state.

    I think you are correct Kyle… but one has to wonder why it is that the petty charges brought up on Halverson were more important to this Committee than alleged sexual abuse charges of a minor that are being leveled at a Family court judge?? Especially considering these charges against Del Vecchio were filed over two years ago. The charges also allege sexual harrassment of current subordinates working for Del Vecchio.

    One really has to wonder why a Chief Judge Kathy Hardcastle would not be jumping up and down to ensure the Discipline Committee review this older more serious case rather than petty charges alleged dozing in court, being “mean” to staff members, and speaking to Jurors non specific to the case. Seems to me, Del Vecchio’s charges are far more serious. So, why was he not suspended?

    Hmmm… I smell a rat….

    “When the ticket issue surfaced last year, court officials reviewed Spoor’s e-mail but found no evidence of illegal activity.
    Michael Sommermeyer, spokesman for the District Court, said Thursday that judicial executive assistants are allowed to refer individuals to lawyers for legal advice. Spoor’s activity would fall under this category, he said.

    When asked why tickets would be sent to a district judge, he said the judges are elected officials who sometimes receive tickets from their constituents.

    He said that the public is free to send traffic tickets to judges at District Court but that it’s up to the judge and staff whether they want to refer it to an attorney.

    He said the practice was similar to Ticket Busters, the local legal service that advertises that it takes care of tickets.”
